Definitions

Stripbuilder / we / us: the provider of the service, registered with the Dutch Chamber of Commerce (KvK) under number 69423962.

Platform / service: the website stripbuilder.nl and the application app.stripbuilder.nl, including all features.

Operator / you: the professional user who creates an account and uses the platform for their photobooth business.

Client: a client of the operator who creates a design or fills in details through a design link.

Subscription: the paid agreement for access to the platform.

AI Magic: the feature that generates images using a third-party AI provider.

Generations / credits: the number of AI Magic generations available within a subscription or balance.

Applicability

These terms apply to all use of the platform and to every agreement between Stripbuilder and the operator. By creating an account or using the platform, you accept these terms. Deviations only apply if we have confirmed them in writing. Any purchasing or other terms of the operator are expressly rejected.

The service

Stripbuilder is software-as-a-service for photobooth operators, allowing operators to create design links, let clients design strips, manage questionnaires and extras and export print-ready files. We make every effort to keep the service working well, but provide it as is and without any guarantee of uninterrupted or error-free availability.

Account and registration

The operator is responsible for providing accurate and complete registration details and for keeping their login credentials confidential. All actions taken through the account are for the account and risk of the operator. If you suspect misuse of your account, report it immediately.

Free trial

New operators can try the platform free for 7 days, including 10 AI Magic generations. No credit card or other payment details are required to start the trial.

The trial does not roll over into a paid subscription by itself and nothing is charged automatically. A paid subscription only starts if you enter your payment details and confirm it yourself, either during or after the trial. If you do nothing, the trial simply ends and access to the platform stops; there is nothing to cancel.

Subscription, pricing and payment

The subscription currently costs €29 per month. Stated prices exclude VAT unless otherwise indicated. A subscription starts once you enter your payment details and confirm it. From that moment payment is handled through our payment provider and is charged in advance for each new period, and the subscription renews automatically until it is cancelled.

You can cancel the subscription monthly, effective at the end of the current billing period. Amounts already paid for a current period are not refunded, except where mandatory law provides otherwise.

Changes to subscription, pricing, AI Magic and credits

The cost of the underlying technology - in particular the third-party AI models that make AI Magic possible - may change over time. In order to offer the service sustainably, Stripbuilder expressly reserves the right to change the price, the subscription terms, the number of included AI Magic generations, the size, value or cost of credits, and the usage limits.

Changes that are unfavourable to the operator, such as a price increase or a reduction in the number of included generations, will be announced at least 30 days in advance by email or in the platform. If you disagree with a change, you may cancel the subscription before the change takes effect; continued use after the effective date constitutes acceptance.

Credits and AI Magic generations represent no monetary value, are not redeemable for cash and are not transferable. Unused generations may expire at the end of a period. We may adjust the number, value or conditions of already granted or purchased credits with reasonable notice where changed third-party costs or other compelling business circumstances make this necessary.

AI Magic - use and limitations

AI Magic depends on third-party services and generative models. We give no guarantee as to the availability, accuracy, suitability or uninterrupted operation of AI Magic, nor as to any specific result. We may apply reasonable usage limits (fair use) to prevent abuse and disproportionate use.

The operator and their clients are themselves responsible for the input they provide and for the use of the generated results. AI Magic may not be used for unlawful, infringing, misleading or offensive purposes.

Operator obligations and GDPR

When the operator processes personal data about their clients through the platform, the operator is the controller within the meaning of the GDPR and Stripbuilder acts as the processor. The operator is responsible for having a valid legal basis, informing their clients correctly and, where required, obtaining consent.

A data processing agreement applies to the processing carried out by Stripbuilder on behalf of the operator, and forms part of this agreement. The operator indemnifies Stripbuilder against all claims from clients, supervisory authorities or other third parties arising from unlawful or insufficiently substantiated processing by the operator.

Acceptable use and prohibited content

You use the platform for lawful purposes only. It is prohibited to upload, create or distribute through the platform any content that is unlawful, infringing, discriminatory, offensive or otherwise contrary to law, or to harm the service, other users or third parties.

We may remove content that breaches these terms and restrict or suspend an account that violates the rules.

Content and intellectual property

The operator and their clients retain the rights to their own designs and uploaded materials. The operator grants Stripbuilder a non-exclusive licence to host, process and display that content insofar as necessary to provide the service.

All intellectual property rights in the platform itself - including the software, design, the templates we provide, texts and logos - belong to Stripbuilder or its licensors. The operator is responsible for holding the necessary rights to materials that they or their clients upload.

Availability and maintenance

We aim for high availability but do not guarantee that the platform is always available without interruption. We may temporarily take the service offline for maintenance, updates or security reasons, and we may add, change or remove features.

Liability

The platform is provided as is. To the extent permitted by law, Stripbuilder is not liable for the way in which operators or their clients use the platform, for the content they create, upload or export, or for decisions they make on the basis of the service.

To the extent permitted by law, Stripbuilder is not liable for indirect damage, consequential damage, lost profit, missed savings or loss of data. Stripbuilder's total liability is in all cases limited to the amount the operator paid to Stripbuilder in the twelve months preceding the event causing the damage.

The limitations in this article do not apply to damage resulting from intent or deliberate recklessness on the part of Stripbuilder, or to liability that cannot be excluded or limited under mandatory law.

Indemnification

The operator indemnifies Stripbuilder against all claims from their clients and from other third parties relating to the use of the platform by the operator or their clients, to the content they provide or generate, or to a breach of these terms or of applicable law.

Suspension and termination

We may suspend or terminate an account with immediate effect if the operator breaches these terms, if there is misuse, or if payment is not made. On termination, the right to access the platform ends. We make every effort to give the operator an opportunity to export their data where reasonably possible.

Changes to these terms

We may change these terms. Material changes will be announced in advance by email or in the platform. If you continue to use the platform after the effective date of the change, you accept the amended terms.

Governing law and disputes

These terms and every agreement with Stripbuilder are governed exclusively by Dutch law. Disputes will be submitted to the competent court in the district of Stripbuilder's registered office, unless mandatory law designates another court.
